Terms of service

These terms are the agreement between you and Scopemate when you use the service. We've tried to keep the language plain. If something isn't clear, email us at admin@scopemate.com.au.

1. Accepting these terms

By creating an account or using Scopemate, you agree to these terms. If you don't agree with them, please don't use the service.

Scopemate is operated by Antonio Escamilla, a sole trader based in Perth, Western Australia (ABN 30 350 870 446). When these terms say "we", "us", or "Scopemate", that's who we mean. When they say "you", we mean you, the person using the service.

2. What Scopemate is

Scopemate is a floor-plan annotation tool. You can upload a floor plan of a home, pin photos and notes to specific locations on it, track items as defects or notes, and search and export what you've recorded. It's intended to help homeowners document custom builds and major renovations.

3. Your account

You need an account to use Scopemate. You're responsible for keeping your sign-in credentials safe and for everything that happens under your account. If you think someone has gained unauthorised access, change your password and let us know.

You must be at least 18 years old to create an account. One person per account.

4. Acceptable use

While using Scopemate, you agree not to:

  • Use the service for anything illegal.
  • Upload content that infringes someone else's rights, or that's defamatory, abusive, or harmful.
  • Pretend to be someone else or misrepresent who you are.
  • Attempt to break, probe, or interfere with the service, or get around any security measures.
  • Reverse engineer the app, or scrape it with bots or automated tools.
  • Use the service to send spam or in a way that places an unreasonable load on our infrastructure.

If we believe you've broken these rules, we may suspend or close your account.

5. Your content

Floor plans, photos, notes, and project data you create or upload ("your content") belong to you. We don't claim ownership of any of it.

To run the service for you, we need a limited licence to handle your content. You grant us a non-exclusive, royalty-free, worldwide licence to store, copy, display, and process your content only as needed to provide Scopemate to you (for example, to show your photos in the app, generate previews, and export your data when you ask). This licence ends when you delete the content or your account.

You're responsible for making sure you have the right to upload what you upload — for example, that any architectural drawings aren't covered by terms that prohibit storage in a service like ours.

6. Your responsibility for what you upload

You are responsible for the content you upload to Scopemate. If a third party makes a claim against us because of content you uploaded — for example, someone whose copyright you've infringed, or whose privacy you've breached — you agree to indemnify us for any reasonable costs we incur in responding to that claim, to the extent the law permits.

This isn't intended to be aggressive. It's there because we're a small operator and can't realistically absorb legal costs caused by what someone else has uploaded.

7. Service availability

Scopemate is currently in free beta. The service is provided on an "as-is" and "as-available" basis. We don't promise any specific uptime, response time, or that the service will be free of bugs or errors.

We may change features, add new ones, remove existing ones, or discontinue the service at any time. If we discontinue the service or remove a feature you depend on, we'll give reasonable notice and a way to export your data first.

8. Free beta and future paid plans

Scopemate is free to use during beta. We may introduce paid plans later. If we do, we'll tell you in advance, and we won't start charging for features you already use without giving you a chance to choose whether to keep using them or export your data.

9. Australian Consumer Law and our liability

If you're a "consumer" under the Australian Consumer Law (ACL), you have certain guarantees that we can't exclude or limit. Nothing in these terms takes away those rights.

To the extent the law allows us to limit our liability, we do so:

  • We're not liable for indirect, consequential, or special losses, or for lost profits, lost opportunity, or lost data beyond what you could reasonably expect from a free beta service.
  • Where the ACL allows us to limit liability for failing to meet a consumer guarantee, our total liability is limited to re-supplying the service to you. If we are unable to re-supply the service, we will refund any fees you have paid for it — which during the free beta is zero.

You're responsible for keeping your own backup of anything important. Scopemate is a useful record, but it shouldn't be the only place you keep critical information about your home.

10. Closing your account

You can close your account at any time from inside the app, which deletes your projects, floor plans, photos, and pins. Deletion of your content follows the timeline described in our Privacy Policy.

We may suspend or close your account if you break these terms, if we're required to by law, or if we shut down the service. Where we can, we'll give you reasonable notice and a chance to export your data first.

11. Governing law and disputes

These terms are governed by the laws of Western Australia, Australia. The courts of Western Australia have non-exclusive jurisdiction over any dispute about these terms or the service.

Before starting any legal action, please contact us at admin@scopemate.com.au so we can try to sort it out directly. Most issues are quicker and easier to resolve that way.

12. Changes to these terms

We may update these terms as the service changes. If we make a material change, we'll notify you by email or with an in-app notice before it takes effect. The "last updated" date at the top of this page shows the current version. If you keep using Scopemate after a change takes effect, that means you accept the updated terms.
